These documents are provided in English, French, and Spanish. The English version is the reference version. Where the law that applies to you requires otherwise (for example, for Quebec consumers under the Charter of the French Language, or for Puerto Rico consumers), the French or Spanish version applies to you.
Trades Metrics Inc. ("TradesMetrics," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect when you use the TradesMetrics platform, websites, and mobile and voice applications, including heyJackie (together, the "Service"), and how we use, share, and protect it. This Policy applies to users in Canada and the United States.
Two roles use the Service: Contractors (general contractors and trades businesses) and Homeowners (also called Clients). Homeowners may join because a Contractor invited them, or sign up directly to build estimates and request quotes. For your own account and use of the Service (including a Homeowner's account details and the estimates they save), we are the controller and decide how the information is used, as described in this Policy. Separately, when a Contractor uses the Service to manage their own clients and jobs, the information they enter about their clients is controlled by the Contractor, and we handle it on their behalf under our agreement with them (see Section 5).
1. Information we collect
Information you give us. When you create an account or use the Service, we collect:
- your name, email, phone number, and the business you work for or represent;
- account login information (for example, the email you register, and credentials when you use email-and-password sign-in);
- project information you enter or upload, such as estimates, contracts, budgets, change orders, daily logs, messages, files, photos, and details about jobs and the people involved; and
- billing details needed to charge our fees. Card and bank account numbers are collected and stored by our payment processor, not by us.
Providing this information is your choice, but some features will not work without it. If you give us information about other people (for example, a Contractor adding a client), you confirm you are allowed to share it, and we will use it only for the purpose it was shared.
Information we collect automatically. When you use the Service, we collect usage and device information such as your IP address, browser and operating system, the pages and features you use, and the dates and times of your activity. We use this to operate, secure, and improve the Service.
Voice information (heyJackie). When you use voice features, we process the audio and the text we generate from it to carry out your request and improve the feature. We keep voice recordings only as long as needed for those purposes. You are responsible for obtaining any consent the law requires from other people before recording or transmitting their voice through the Service. heyJackie processes the words you speak to carry out your request. It does not create a voiceprint and does not use your voice to identify you.
2. How we use information
We use information to:
- provide, maintain, support, and improve the Service;
- process payments and our fees through our payment processor;
- send you service messages (for example, account, billing, project, and status notifications);
- with your consent where required, send you product news and offers, which you can opt out of at any time through the unsubscribe link or your settings;
- improve our cost models and estimate accuracy using anonymized, aggregated data that does not identify you or your clients; and
- protect the Service, enforce our Terms, prevent fraud or abuse, and comply with the law.
For email and text messages, we follow Canada's Anti-Spam Legislation (CASL) and the US rules that apply to commercial messages, including the Telephone Consumer Protection Act (TCPA) for texts. Message and data rates may apply to texts, and you can reply STOP to opt out or HELP for help. Opting out of marketing does not stop the service messages needed to run your account.
3. Cookies and similar technologies
We use cookies and similar technologies to keep you signed in, remember your preferences, understand how the Service is used, and measure where visitors come from, so we can improve the Service and our marketing. This includes first-party product analytics and session replay from PostHog, which records how the app is used, with inputs such as passwords and email fields masked, to help us find and fix problems. Most browsers let you control or disable cookies; some features may not work if you do. Because we do not sell or share your personal information for advertising (see "How we share information" below), we do not respond to "Do Not Track" (DNT) or Global Privacy Control (GPC) signals.
4. How we share information
We do not sell your personal information, and we do not share it for cross-context behavioural or targeted advertising. We share information only as described here:
- Service providers who help us run the Service (for example, Supabase and Vercel for hosting, Stripe for payment processing, Resend for email, a third-party SMS/text-message delivery provider, PostHog for product analytics, Anthropic for reading receipts you upload (extracting the information from the image), Cloudflare for bot and abuse protection, and Google and Apple for maps, address lookup, and sign-in), under agreements that limit their use of the information to providing those services;
- Between users you choose to share with, such as when a Contractor sends an estimate, invoice, or message to a Client, or invites a collaborator to a project, or when a Homeowner sends a project scope to a Contractor they choose to request a quote (we share the scope you choose to send, not any price);
- Legal and safety, when we reasonably believe disclosure is required by law or legal process, or is needed to protect the rights, safety, or property of TradesMetrics, our users, or others; and
- Business transfers, if we are involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to this Policy.
5. When you are a Contractor's client
This section applies when a Contractor invited you to a project. The Contractor decides what information to collect and how to use it within the Service, and we process that information on their behalf; for requests about that information, contact the Contractor directly and we will support them in responding (governed by Section 9a of our Terms). However, if you signed up directly as a Homeowner (not through a Contractor), we are the controller of your account and the estimates you save, and you can exercise your privacy rights with us directly under Section 8.
6. Data retention
We keep your information for as long as your account is active and as needed to provide the Service, and afterward as needed to meet legal, tax, accounting, or dispute-resolution requirements. When we no longer need it, we delete or anonymize it, or securely store and isolate it until deletion is possible.
7. Security
We use administrative, technical, and organizational safeguards designed to protect your information against unauthorized access, use, or disclosure. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
8. Your privacy rights
Depending on where you live, you have privacy rights, and we honour them across Canada and the United States. You can review and update much of your information in your account settings, or contact us at help@tradesmetrics.com and we will respond within the time the law requires. We will not discriminate against you for exercising your rights.
United States. Under California's Consumer Privacy Act as amended by the CPRA, and under similar laws in Virginia, Colorado, Connecticut, Utah, Texas, and other states, you may have the right to know about and access the personal information we hold, to delete it, to correct it, to opt out of any sale or sharing for targeted advertising, to limit the use of sensitive information, and to appeal a decision we make about a request. As stated above, we do not sell your personal information or use it for cross-context behavioural advertising. You may use an authorized agent to make a request, and we will verify your identity before acting on it. California residents may also ask about the categories of information we collect, the purposes we use it for, and the categories of parties we share it with, which we describe in this Policy.
Canada. Under the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and provincial laws, including Quebec's Law 25 and the personal-information laws of British Columbia and Alberta, you may access and correct your personal information, withdraw your consent (which may limit some features), and ask how we handle your information. You may also contact the Office of the Privacy Commissioner of Canada or your provincial privacy regulator. Our Privacy Officer is responsible for our compliance with this Policy and can be reached at help@tradesmetrics.com. If a confidentiality incident creates a risk of serious injury, we will notify affected individuals and the Commission d'accès à l'information as Quebec's Law 25 requires, and we keep a record of confidentiality incidents.
To exercise any right, email help@tradesmetrics.com.
9. Children
The Service is intended for businesses and adults. It is not directed to anyone under 18, and we do not knowingly collect personal information from anyone under 18. If we learn we have, we will delete it.
10. Where your information is processed
We operate from Canada and use service providers that may store and process information in Canada and the United States. By using the Service, you consent to your information being processed and transferred in this way. Information held in a given country may be subject to the laws of that country, including lawful access by its courts and authorities.
11. Changes to this Policy
We may update this Policy from time to time. When we do, we will post the updated version with a new "last updated" date, and for material changes we will provide additional notice where required.
